Abstract
This article analyses refoulement and the limits that constitutional and international law impose on this power. Referring to the border refoulement, this article focuses on the theme of the de facto detention of aliens at airports before they leave the country. This detention is not based on law and, therefore, must be considered illegal and in violation of article 13 of the Constitution. This article also concludes that the so called “international zones” of airports must be considered as a part of the national territory and, therefore, the application of constitutional and international law may not be excluded. This article also examines the deferred refoulement, analyzing both the decision of the constitutional Court n. 275/2017 and the following decree 113/2018 (converted into law n. 132/2018), which put in place the requested modification.
