Abstract

The thesis of the impossibility of electing as precautionary rule an alleged duty not to create suspicion (whose violation would integrate in general gross negligence hindering the repair of the unjust detention, when the bad company have caused the precautionary measure) is once again explored by the jurisprudence, as repeatedly supported on these pages. The Supreme Court also affirms the right to avoid the unjust imprisonment, offering insights on the relationship between individual freedom and personal precautionary measures.
