La transparence publique par l’ouverture des données personnelles ? Focus sur les systèmes juridiques italien et français

Abstract

In the historical moment when the philosophy and practice of Open Government Data benefit from a legal framework more and more accomplished, Italy and France are testing its application to certain categories of personal data for enhancing transparency in the Public Administration. This raises many questions about the (technical and legal) proceedings to ensure an appropriate balance between citizens’ demand for higher transparency and the fundamental right to protection of personal data. The choices of national legislators will be compared with the most recent developments of the Community rules on re-use of public sector information (Directive 2013/37/EU) and the protection of individuals with regard to the processing of personal data and on the free movement of such data (proposal for a General Data Protection Regulation - COM(2012)0011).
