Abstract
The rapid spread and typological variety of virtual currencies make difficult their regulation and their classification into the general categories of law. The Market in Crypto-assets Regulation (n. 1114/2023, so-called MICA Regulation) keeps virtual currencies created through so-called mining out of its application. Starting from a structural analysis of Bitcoin, the best-known virtual currency, the paper proposes to examine its compatibility with the legal system by highlighting the profiles of fraud on the law.File | Size | Format | |
