Abstract

The "Strøbye et Rosenlind" and "Caamaño Valle" judgments, delivered by the European Court of Human Rights respectively on February 2, 2021 and May 9, 2021, revisit the right to vote of people with mental disabilities. They both specify the conditions under which restrictions on the right to vote can be applied to people with intellectual disabilities. These judgments confirm a wide (but incomplete) margin of appreciation granted to Contracting States in placing limitations on the exercise of this fundamental right.
