Gli emolumenti non retributivi e la gratuità: il caso delle Camere di Commercio e delle Camere arbitrali

Abstract

This paper deals with the issue of fees, which are provided to holders of honorary public charges, in order to enlighten the uncertainties and overlaps that characterize the subject and in an attempt to overcome them through a systematic coordination with the general categories of Law. The general analysis also enables to deal with the specific case of the fees of the Chambers of Commerce’s and the Arbitration Chambers’ bodies, thus leading to a systematic reading of the complex legislative evolution that concerns them.

Il presente contributo affronta la tematica degli emolumenti corrisposti ai titolari di incarichi pubblici svolti a titolo onorario, evidenziando le incertezze e le sovrapposizioni che la connotano e cercando di superarle attraverso il coordinamento sistematico con le categorie generali del Diritto. L’analisi generale consente altresì di trattare il caso specifico degli emolumenti degli organi delle Camere di Commercio e delle Camere arbitrali, giungendo così a una lettura sistematica della complessa evoluzione normativa che li concerne.
