Abstract

This contribution aims to provide a critical reading of the provisions introduced by the Italian legislator dealing with the effects resulting from the coronavirus pandemic in package travel contracts. In this context, the attention will be focused in particular on art. 88-bis of the legislative decree n. 18/2020 (as converted into law no. 27/2020) which represents the heart of the emergency provisions for transport, tourism and leisure, and shows many problematic aspects arising not only from the conflict with the European standards, but also from the inconsistency with Italian fundamental principles concerning contracts and consumer protection.

L’articolo ha l’obiettivo di offrire una lettura critica delle norme introdotte dal legislatore italiano al fine di regolare gli effetti della pandemia di coronavirus sui contratti di pacchetto turistico. L’analisi è incentrata sull’art. 88-bis del d.l. n. 18/2020 (convertito dalla l. 27/2020), fulcro delle disposizioni emergenziali in materia di turismo e trasporti, che presenta molteplici aspetti problematici derivanti non solo dalla incompatibilità con la disciplina europea, ma anche con i principi fondamentali dell’ordinamento giuridico italiano in materia di contratti e protezione del consumatore.
