Science and the European dimension of freedom of the arts and science

Abstract

Freedom of scientific research and the closely related academic freedom exist in European legal systems as universal freedoms. Such freedoms appear to be founded directly on the value of the human person, irrespective of EU citizenship, and on the common law tradition of freedoms and fundamental rights in Europe. The European dimension of academic freedom is a clear hermeneutical parameter of constitutional identity. A shared European constitutional identity can only be built by political choice.
