Il patto di gestione di lite: quali 'conflitti' di interesse?

Abstract

This paper, after having illustrated the legal regime of the composition of the interests of the insured and the company in the management of the dispute established with the injured third party in the context of civil liability insurance, focuses on the possibility for the parties to affect this structure through the so-called management agreement of the dispute, examining the institution and also noting the differences between it and the guarantee of legal protection.

Lo scritto, dopo aver illustrato il regime legale della composizione degli interessi dell’assicurato e dell’impresa nella gestione della lite instaurata con il terzo danneggiato nel contesto dell’assicurazione della responsabilità civile, si sofferma sulla possibilità per le parti di incidere su tale assetto tramite il c.d. patto di gestione della lite, esaminando l’istituto e segnando altresì le differenze intercorrenti tra lo stesso e la garanzia di tutela legale.
