Abstract

The essay investigates private cyberspace powers such as Facebook, Google, and Amazon. After identifying their distinctive characteristics and their impact on constitutional free- doms, the author proposes the enhancement of the constitutional dimension of antitrust and the implementation of a Brandeisian regulatory approach based on the “constitutional capture” of the digital economy. The aim is to limit the private powers that populate the world of online platforms.
