The paper analyzes the notions of risk, loss, and damage in civil liability insurance, in order to clarify, on the insurability of previous facts. lt is, as is well known, one of the main problematic issues raised by the addition of the claims made clauses to the contracts of civil liability insurance, which have been analyzed by recent (and in some ways not coinciding) judgments of the United Sections of Italian Supreme Court of Cassation.
