Abstract

The author investigates the basis of resistance costs, focusing on the insured subject’s interest in managing the accident and then lin-gering on the relationships between the resistance costs and the res-cue activity. Particular importance is attributed to the legislative choice to limit insurer’s disbursement for such expenses to a quarter of the insured sum in the event that the indemnity doesn't surpass the insured capital; in this regard, a possible solution has been ad-vanced.

L'autore indaga il fondamento della disciplina delle spese di resistenza, prendendo le mosse dalla possibile cointeressenza dell'assicurato alla gestione del sinistro per poi soffermarsi sui rap-porti tra le spese di resistenza e l'attività di salvataggio. Particolare rilievo viene attribuito alla scelta legislativa di limitare l'esborso a carico dell'assicuratore per tali spese al quarto della somma assicu-rata nel caso in cui l'ammontare dell'indennizzo non superi il capitale assicurato e viene avanzata, al riguardo, una possibile soluzione.
