Abstract

Why is an ancient regula juris as the principle Mater semper certa felt today as an useful and important tool by many feminists in Italy? And what does this tell us about the relationship between Italian Feminism and Law? This essay ventures among these questions trying to propose a way out of the worn alternative between formalism and anti-formalism, and recovering the value of Law as Experience.
