Abstract
Interpretative guidelines set by Federico Stella, and best precedents, ask a judge «corpuscolariano» (newtonian), i.e. user, not creator of scientific laws.Ajudgewhoselects and uses only laws capable of founding a causal relationship beyond any reasonable doubt, and acquit otherwise. Multiply, however, the case law granting new space to «penal subjectivism», depicting the «culture of evidence» as «excessive warranty». The first judgment noted, in front of scientific uncertainty, condemns according to statistical knowledge; the second sentence correctly decide the acquittal of the accused, but wrong about the method: the acquittal is not based on the absence of certain scientific laws, but on the presence of possible alternative causes.File | Size | Format | |
