Abstract
The pandemic and emergency legislation have profoundly and unexpectedly changed the socio-economic environment that existed before the spread of SARS-CoV 2. That generated a significant modification in the balance between contractual obligations in many commercial leases. As a result, there has been a huge dispute over the payment of the rent originally agreed and the suspension of related guarantees. This comment analyzes the issue in light of two decisions made by the Court of Rome that resolved the matter in two ways opposed. In one case, the Tribunal of Rome recognized the existence of a legal obligation to renegotiate the contract and reduced the rent for the months of the lockdown. In the other, it rejected the request to reduce and return the payments made during the lockdown.File | Size | Format | |
