Abstract

The work aims to analyze the right of redress provided for by law 8 March 2017, no. 24 on medical liability. The analysis of the legal framework matches the research on the legal nature of the right of redress starts from the relationship between the healthcare professional and the medical center and continues focusing on the main issues of the inner relationships (also by a processual perspective) between them towards the damaged patients.

Il lavoro è dedicato all’azione di rivalsa prevista dalla legge 8 marzo 2017, n. 24 in materia di responsabilità sanitaria. All’analisi normativa si accompagna la ricerca della natura giuridica della rivalsa la cui ricostruzione prende le mosse dal rapporto di preposizione che intercorre tra il medico e la struttura sanitaria per poi incentrarsi sulle problematiche, anche di natura processuale, nascenti dal rapporto interno tra i soggetti coobbligati nei confronti del paziente danneggiato.
